Terms of Use
Last updated: November 3, 2026
These terms govern your use of magpielocal.com. Magpie is a service operated by Extra Medium LLC, a Virginia limited liability company. Magpie is in pre-launch: this site takes founding applications for Magpie's 45 founding markets in 13 countries. Full platform terms will apply at launch and will be presented before any paid subscription begins.
Applications are not acceptance
Submitting a creator, business, or city-request application is an expression of interest, not acceptance, membership, or a contract. Founding applicants are reviewed in submission order; acceptance is confirmed by email from Magpie. Founding status, once granted, does not by itself guarantee visits, bookings, or earnings.
How creator visits work
On standard visits, a creator's compensation is the comped meal, service, or experience offered by the business, not cash. In exchange, the creator posts about the visit, with the goal of posting within 48 hours of the visit. Creators have up to 7 days to post: a post that lands inside the 7 days counts as delivered, though late, and if 7 days pass with no post, the visit does not count and Magpie may reassign the visit or replace it with another creator. Posts must be honest, and every post must carry a clear disclosure (for example, "comped" or #ad), as required by FTC guidelines. Creators who no-show or fail to post lose standing and may be removed from the roster.
Posting standards, late posts and no-shows
The 48-hour goal and the posting standards in this section apply to comped visits. Paid bookings carry the posting terms agreed for that booking: those terms are set by the business, shown to the creator, and accepted by the creator before the visit, and the agreed terms are what govern a paid visit. For comped visits, the standard is as follows. A post published within 48 hours of the visit is on time and earns full Momentum. A post published within 7 days counts as delivered but is late: it earns no on-time Momentum, and it is recorded against the creator's on-time record, which is an input to creator ranking and affects how prominently the creator is shown to businesses. Three consecutive late posts pause the creator's eligibility for new offers for 14 days. If 7 days pass with no post, the visit is a no-show: it does not count, Magpie will replace the visit for the business at no cost against the business's plan, Magpie may assign the visit to another creator, and the creator's account is paused, with no new offers, until the no-show is resolved. A no-show is not a strike where the creator communicated the problem to the business or to Magpie; a no-show without communication is a strike, and two strikes result in removal from the platform. A creator who attends a comped visit and uses the comp but never posts does not stay active: one month after the visit, a creator who has consumed the comp and posted nothing is removed from the active roster and is no longer eligible for further opportunities. A post published at any time within that month still resolves the visit as delivered, extremely late. On paid bookings, the creator is not paid until the post is live, so a paid visit with no post simply does not pay.
How business subscriptions work
Founding pricing shown on this site is locked for founding members' first term. Subscriptions carry a 3-month minimum term. Magpie guarantees tracked deliverables, verified in your dashboard: the goal is a post within 48 hours of each completed visit, every post is due inside 7 days, and a visit that does not deliver is replaced under the Visit Guarantee. Magpie does not guarantee a specific number of creators, which no honest platform can promise. Businesses set the value of their own comp offers. Businesses may not require positive posts or reviews; honest posts are the product.
Bookings that start on Magpie stay on Magpie
When a business and a creator first connect through Magpie, whether by first contact, an offer, or a booking made on the platform, that working relationship started on Magpie. For 12 months from that first start, the business and the creator agree to book and pay for work between them through Magpie, and neither side may arrange the same work off the platform to avoid Magpie's fees. This applies to businesses and creators equally. Bookings that run through Magpie carry the Visit Guarantee and payment protection; work arranged off the platform carries neither.
Refunds and the Visit Guarantee
Visit Guarantee: if a booked creator does not show up or does not post, that visit does not count against your monthly visits. It is replaced.
Paid bookings: paid bookings open with the paid lane, and nothing is charged before then. When paid bookings are running, payment is held by Magpie until the post is live, and if the visit does not happen or the post never lands, the business is refunded in full.
Plans: if we cannot deliver the service, including a founding market that does not open, founding businesses receive a full refund of what they paid for that market. Plans run month to month after the 3 month minimum. Cancelling stops future billing. Visits already delivered are not refundable.
Creators: joining Magpie and comped visits are always free for creators. On paid bookings the platform fee is 6 percent total, split evenly, so creators keep 97 percent of their rate.
Acceptable use
Don't submit false information, impersonate anyone, or use this site to harass creators or businesses. Don't attempt to arrange off-platform deals with roster creators introduced through Magpie during an active subscription.
Intellectual property
The Magpie name, logo, and platform belong to Magpie. Creators keep ownership of the content they post, always. What a business may do with a post follows the visit, not the plan: on a comp visit, the business may share the post natively only, with no downloads, no reposting of the file, and no advertising use; on a paid visit, the business also receives one standard license: repost and advertising use for 90 days from the post date, never in perpetuity.
Liability
This site is provided "as is" during pre-launch. To the extent permitted by law, Magpie is not liable for indirect or consequential damages arising from use of this site or participation in the founding application process. These terms are governed by the laws of the Commonwealth of Virginia.
